Agreement between user and www.WeFund4U.com (WeFund4U, LLC)
Wefund4u.com exists for the purpose of providing a fundraising service for schools, teams, events or organizations. (The Service”). Any use outside of this purpose is prohibited. These terms of use apply exclusively to your access and use of WeFund4u.com, and any parts or sections thereof including, but not limited to, WeFund4u.com web content, member-personalized registry information, member profile information, photos, and graphics (hereinafter referred to as the “Site”). If you do not agree with any of these terms, do not access or otherwise use the Site or any information or materials contained on the Site. Your use of the Site shall be deemed to be your agreement to abide by each of the terms set forth below. You understand and agree that the Site is provided “AS-IS” and that WeFund4u.com, LLC. assumes no responsibility for your ability to (or any costs or fees associated with your ability to) obtain access to the Site. Nor does WeFund4u.com, LLC. assume any liability for the failure to store or maintain any user communications or personal settings. WeFund4U does not solicit any activities on the behalf of any team, school, event or organization. Your use of the platform and services offered by WeFund4U constitutes your agreement to these terms. Privacy Policy
These policies describe the way we collect, store, use and protect your personal information. You accepted this policy when you signed up for our Service. We may amend this policy at any time by posting a revised version on our website. Please read this Privacy Policy carefully.
User Information/Account
We provide this Service to teams, groups, and organizations conducting fundraisers that have been approved and authorized. Once a fundraiser or group has been authorized to use the software, they will be given an 8 digit join code to access the services provided. Any attempt to gain unauthorized access is prohibited. Password Restricted Areas of the Site. Certain areas of the Site may be password restricted to registered users (“Password-Protected Areas”). If you have registered as an authorized user to gain access to these Password-Protected Areas, you agree that you are entirely responsible for maintaining the confidentiality of your password, and agree to notify WeFund4U, LLC if the password is lost, stolen, disclosed to an unauthorized third party, or otherwise may have been compromised. You agree that you are entirely responsible for any and all activities that occur under your account, including any fees that may be incurred under your password-protected account, whether you are the individual who undertakes such activities. You agree to immediately notify WeFund4U, LLC of any unauthorized use of your account or any other breach of security in relation to your password or the Site that is known to you.
WeFund4U reserves the right, in its sole discretion to terminate, cancel, remove or edit content at any time and without notice. WeFund4U does not knowingly collect, either online or offline, personal information from persons under the age of thirteen. If you are under 18, you may only use WeFund4U conjointly with a parent or guardian who agrees to these Terms of Use and has given you permission.
Copyright
Use of Copyrighted Materials/Trademarks. Any materials on the Site, including without limitation any documentation, content, text, data, graphics, images, interfaces or other material or works of authorship (the “Materials”) are copyrighted material owned by or licensed to WeFund4U, LLC. All rights are reserved. The Materials contain trademarks, service marks and trade names which are owned by WeFund4U, LLC. and may also contain brand and product names which are trademarks, service marks or trade names of third parties which are owned by their respective owners. Except as otherwise noted in the Site, you are hereby authorized to view, download, cache, copy and print the Materials solely for your personal use and not for resale or further distribution, subject to the following conditions: Any copy of the Materials or portion thereof must include the WeFund4U, LLC. copyright notice. WeFund4U, LLC reserves the right to revoke such authorization at any time, and any such use by you shall be discontinued immediately upon notice from WeFund4U, LLC. You agree to observe and abide by all copyright and other proprietary notices, legends or other restrictions contained in any such content and will not make any changes thereto. You will use protected content solely for your personal use and will make no other use of the content without written permission of WeFund4U.
No unlawful or prohibited use/Intellectual Property
Nothing contained in the Site shall be construed as conferring any license or right under any copyright, trade secret, patent, trademark or other intellectual property rights (“IP Rights”) of WeFund4u.com, LLC. or any third party, and, except as expressly provided herein, all such IP Rights in the Materials on the Site are expressly reserved to WeFund4u.com, or any third party, as applicable. You may not use the site in any way to damage, intentionally overload, disable, crash, or interfere with the day-to-day operations of the site. You agree that you do not acquire any ownership rights in any protected content. We do not grant you any licenses, express or implied, to the intellectual property of WeFund4U or our licensors except as expressly authorized by these Terms.
No Reverse Engineering
No party, as Recipient, shall decompile, disassemble, reverse engineer or attempt to reconstruct, identify or discover any source code, underlying ideas, techniques or algorithms in Confidential Information by any means whatever, except as may be specifically authorized in advance by Discloser in writing. As agreement to these terms, no party shall aid a 3rd party in decompiling, disassembling, reverse engineering, reconstructing, or copying the underlying ideas, techniques and algorithms present within WeFund4u’s fundraising process.
Payments/Fees
WeFund4U allows teams, groups, and organizations to receive and process donations for their fundraiser via our online software platform, campaign fundraiser coach, and flyer donation feature. A service fee will be charged by WeFund4U in exchange for the WeFund4U service. The service fee includes all labor, programming, marketing material, advertising, corporate sponsorships, and telemarketing costs.
Fee Schedule
- Service is contracted on per fundraiser basis
- Payment gateway Fees: 3% credit card processing fee which is pass through fee from our 3rd party payment processor.
- When donors choose to cover the transactional fees upon checkout, they will subsequently be applied to off-set the cost of credit card chargebacks, transactional fees and operational costs.
WeFund4U will hold any funds received through online donations and mobile fundraiser sales in a non-operating bank account for the duration of the fundraiser. WeFund4U will thereby remit funds to the designated group, team, or organization by check or electronic bank transfer upon the conclusion of the fundraiser campaign, less a percentage service fee of all donations. WeFund4U service fee will be contractually agreed upon with organizations prior to the start of the fundraiser. This service fee will be withheld from all donations by WeFund4U in exchange for services rendered.
Refund Policy
If the fundraiser that you have donated has ended, WeFund4U will not be able to process a refund, as the funds have already been transferred to the users account. To collect a refund, you will need to contact the school or program and inquire about them refunding the donation, as we are no longer in possession of the funds. Upon request, we can provide the contact information of the admin or person responsible for the fundraiser. If the fundraiser you donated to is still active and the donation amount was made in error, WeFund4U can and will process a refund. Users agree that they will not use an unauthorized credit card in making transactions on the WeFund4U site. Transactions are only subject to dispute if unauthorized use of the donor’s payment card is proved. If you become aware of fraudulent use of your card, please notify your card provider immediately. All sales via popcorn fundraisers are final. We cannot issue a refund if these consumable items have shipped as they are perishable. If the order has not shipped out, we will try to place a stop and issue a refund before shipment. We cannot guarantee this and thus, all orders are final.
Electronic Communications
Visiting www.WeFund4U.com or sending emails to WeFund4U constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.
Links to 3rd Party Sites
Links to Third Party Websites. The Site may be linked to other websites on the World Wide Web or Internet that are not affiliated with, under the control of, or otherwise maintained by WeFund4U, LLC. If you use these links, you may leave the Site. WeFund4U, LLC has not reviewed all these third-party sites and does not control and is not responsible for any of these sites or their content. WeFund4U, LLC does not endorse or make any representations about third party sites or any information, software or other products or materials found there, or any results that may be obtained from using them. If you decide to access any of these third-party sites linked to the Site, you do so entirely at your own risk. By using any product, service, or function of WeFund4U you give express consent that WeFund4U may share such information with a contracted 3rd party in order to allocate the appropriate product, service or function on behalf of WeFund4U.com users and customers.
User Content/Accounts
WeFund4U does not claim ownership of the materials you provide to www.WeFund4U.com (including feedback and suggestions) or post, upload, input or submit to any WeFund4U Site or our associated services (collectively “Submissions”). You acknowledge that you are responsible for the information, photographs, graphics, messages, content and other material that you upload, post, e-mail or otherwise submit to the Site, and that you have full responsibility for each of your submissions, including its legality, reliability, appropriateness, originality and copyright. You acknowledge that you are responsible for any and all model releases. However, by posting, uploading, inputting, providing or submitting your Submission you are granting WeFund4U, our affiliated companies and necessary sublicenses permission to use your Submissions in connection with the operation of their Internet businesses including, without limitation, the rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your Submissions; and to publish your name in connection with your Submissions. WeFund4U is under no obligation to post or use any Submission you may provide and may remove any Submission at any time in WeFund4U’s sole discretion.
International Use
The Service is controlled, operated and administered by WeFund4U from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the content accessed through www.WeFund4U.com in any in any manner prohibited by any applicable laws, restrictions or regulations.
Indemnity
You agree to indemnify, defend and hold harmless WeFund4u, LLC., affiliates, directors, officers, agents, vendors or other partners, and employees, from any claim or demand, including attorneys’ fees, made by any third party due to or arising out of any material or information posted, provided, transmitted, or otherwise made available by you on the Site, or by your use of the Site, or by your violation of WeFund4U, LLC’s Terms of Use, or your violation of the rights of another.
Limitation of Liability
PRODUCTS, SERVICES AND RELATED GRAPHICS ARE PROVIDED “AS IS” WITHOUT WARRANTY OR CONDITION OF ANY KIND. WEFUND4U AND/OR ITS SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WEFUND4U AND/OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SITE, WITH THE DELAY OR INABILITY TO USE THE SITE OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE SITE, OR OTHERWISE ARISING OUT OF THE USE OF THE SITE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF WEFUND4U OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE. WEFUND4U MAKES NO REPRESENTATION AS TO WHETHER ALL OR PART OF YOUR ONLINE DONATIONS ARE TAX DEDUCTIBLE.
Code of Conduct
Code of Conduct. Online behavior requires common sense and basic etiquette. Accordingly, here are some rules that you agree to follow as a condition of accessing the Site:
- No strong, vulgar, obscene, or otherwise harmful language.
- No racially, ethnically or otherwise, objectionable language.
- No libelous, defamatory, or otherwise tortuous language.
- No impersonating any person, including, but not limited to, other community members or employees of WeFund4U, LLC
- No posting, distributing, transmitting, or promoting illegal content.
- No invasion of another’s privacy.
- No actions that are harmful to minors.
- No manipulation or forging of identifiers in order to disguise the origin of any information posted on the Site or otherwise provided to WeFund4U, LLC or its employees.
- No posting, providing, transmitting, or otherwise making available any information (such as inside, proprietary or confidential information) that you do not have a right to make available due to contract, fiduciary duty, or operation of law.
- No posting, providing, transmitting, or otherwise making available any junk mail or spam.
- No posting, uploading, e-mailing, or otherwise transmitting any material that contains any malicious computer code (including spyware, worms, Trojan horses, viruses, etc.).
- No posting, providing, transmitting, or otherwise making available any information which violates regulations promulgated by the Securities and Exchange Commission, or that of any securities exchange, such as the New York Stock Exchange.
- No collecting, storing, or posting of personal data about or of other WeFund4U.com members.
- No soliciting site users for any purposes other than those for which the site was created.
Termination
Termination. You agree that, under certain circumstances and without prior notice, WeFund4u, LLC may terminate your access to the Site, including purging your member account and any material and information associated with your member account (including your username, password, registry and profile). Cause for such termination shall include, but not be limited to, violation of these Terms of Use. You acknowledge and agree that all terminations for cause shall be made in sole discretion of WeFund4U, LLC and that WeFund4U shall not be liable to you or any other party for the termination of your access to the Site or the purging of any material. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Idaho and you hereby consent to the exclusive jurisdiction and venue of courts in Idaho in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section. You agree that no joint venture, partnership, employment, or agency relationship exists between you and WeFund4U as a result of this agreement or use of the Site.
User Request for Account and Data Deletion
User may request that their account and all of their data be deleted by emailing info@wefund4u.com and requesting such deletion. Please include your username and if you want all your data deleted. We will verify the account before deletion by sending a verification email to the users email address. The request will be processed with in 48 business hours.
Third Party Accounts
The functionality of the site will allow you to connect to third party accounts. By connecting your WeFund4U account other third-party accounts, you acknowledge and agree that you are consenting to the continuous release of information about you to others in conjunction with privacy setting and policies of that third party. If you would prefer your information not be shared on other third-party accounts, then please do not use that feature.
YouTube API Services
This policy informs the user that WeFund4u uses YouTube API Services as an online resource to which our website may link or otherwise reference that you may access through our website (“Third-Party Services”). Therefore, our website utilizes the YouTube API Services, and you are agreeing to be bound by the YouTube Terms of Service (https://www.youtube.com/t/
In addition to the normal procedure for deleting stored data, users can revoke that access to their data via the Google security settings page at https://security.google.com/settings/security/permissions
Changes to Site
Changes to the Site. WeFund4u, LLC. reserves the right from time to time to make modifications and changes to the Site. These modifications and changes may include, but are not limited to, discontinuing, temporarily or permanently, any service offered by, or through WeFund4u, LLC. (or any part thereof) with or without notice. You agree that WeFund4u, LLC. shall not be liable to you or to any other party for any changes and modifications to the Site.
Changes to Terms
WeFund4U reserves the right, in its sole discretion; to change the Terms under which www.WeFund4U.com is offered. The most current version of the Terms will supersede all previous versions. WeFund4U encourages you to periodically review the Terms to stay informed of our updates.
